Stop Foreclosure and Repair Your Credit

A mortgage is in default when you are just one payment behind. Once you have fallen behind, the mortgage company has the right to add fees, interest and other charges to your loan, ultimately leading to foreclosure. Here is an example of a typical unchallenged foreclosure.

  • 10/15/2011 – October payment past due.

  • 11/15/2011 – November payment past due and account is now two months late.

  • 12/15/2011 – December payment past due and account is in default for three months.

  • 12/29/2011 – Lender sends Notice of Intent to Foreclose (Act 6 Notice) to the borrower. The lender will also send an Act 91 Notice, if applicable.

  • 01/31/2012 – Act 6 and Act 91 notices have expired. Lender refers account to foreclosure attorney.

  • 03/02/2012 – Foreclosure attorney begins the legal foreclosure process by filing a formal Complaint at the county courthouse and serving the Complaint on homeowner via the County Sheriff’s Office. (30-day period to respond begins)

  • 04/03/2012 – Borrower does not respond to the Complaint, and a Default Judgment is entered with the court.

  • 04/30/2012 – Sheriff’s office schedules a Sheriff’s Sale date.

  • 05/30/2012 – Notice of Sheriff’s Sale is sent to each mortgagor on the loan.

  • 07/02/2012 – Sheriff’s Sale is held.

  • 07/10/2012 – Sheriff prepares and records a deed conveying title to the purchaser. If a third party does not buy the property, the deed will convey title back to the lender.

  • 08/10/2012 – Eviction process may begin.

Of course, there are many variables that may delay or stop the foreclosure process. First of all, follow the instructions contained in the Act 6/Act 91 Notice regarding counseling. Try to work with your lender for solutions. Contact the Pennsylvania Housing Finance Agency. Speak with community foreclosure assistance agencies.
